1. General Information
These Terms & Conditions govern the use of ECUFiles.shop and the purchase of digital automotive files through our WooCommerce online store.
The website is operated under the business name Kovacs.cloud, registered in Hungary.
For the purposes of these Terms, “we”, “us” and “our” refer to the operator of ECUFiles.shop, while “you” and “customer” refer to users and purchasers of our products.
By using our website or placing an order, you agree to these Terms & Conditions.
2. Products and Digital Delivery
ECUFiles.shop sells digital automotive ECU (Engine Control Unit) files and related electronic content.
We sell digital products only. No physical goods are sold or shipped.
Products may include ECU tuning files, calibration files and other automotive electronic files as described on their respective product pages.
After successful payment, purchased files are normally made available for instant download through the website, order confirmation page or customer account.
No shipping fees, postal delivery or physical delivery are applicable.
If a download fails or a file cannot be accessed, please contact info@ecufiles.shop with your order number.
3. Orders and Payments
Customers must provide accurate information when placing an order, including a valid email address.
Prices, applicable taxes and the total amount payable will be displayed at checkout before the order is completed, as required by law.
Payment must be successfully completed before download access is granted, unless otherwise expressly stated.
Payments will be processed through the payment methods made available at checkout. Payment providers may apply their own terms and privacy policies.
An order confirmation will be sent electronically where applicable.
We reserve the right to investigate suspected fraudulent orders and take appropriate action in accordance with applicable law.
4. Compatibility and Customer Responsibility
ECU files may depend on the vehicle model, engine, ECU hardware and software versions, calibration identifiers and programming equipment.
Customers are responsible for checking the compatibility of a product with their intended application before purchasing.
Where a product requires an original ECU file or technical information from the customer, the customer is responsible for supplying accurate and complete information.
We are not responsible for compatibility problems caused by incorrect customer information, incompatible equipment, improper installation or unauthorised file modifications.
Unless expressly stated on a product page, the purchase price does not include installation, vehicle diagnostics, ECU programming, remote assistance or mechanical repairs.
These provisions do not exclude mandatory statutory rights concerning defective or non-conforming digital content.
5. Intended Use and Legal Compliance
Customers are responsible for ensuring that purchased ECU files and any resulting vehicle modifications comply with all laws applicable to their location and intended use.
This includes applicable emissions, roadworthiness, vehicle inspection, insurance and safety requirements.
Products must not be used to carry out unlawful modifications or to disable emissions-control or safety systems in violation of applicable law.
Customers should obtain qualified technical advice where necessary and determine whether a modification is lawful for public-road use or restricted to a permitted motorsport or off-road application.
We do not guarantee that a modified vehicle will pass an inspection, meet emissions requirements, remain road-legal or be accepted by an insurer.
Nothing in these Terms authorises unlawful activity or excludes liability that cannot legally be excluded.
6. Digital Content, Withdrawal and Refunds
Because products are delivered electronically, customers should review the product description and compatibility information carefully before ordering.
Under applicable EU consumer law, consumers generally have a 14-day withdrawal right for distance contracts, subject to exceptions.
For digital content not supplied on a physical medium, the withdrawal right may be lost once supply begins only when the required legal conditions are met. These generally include the customer’s prior express consent to immediate supply, acknowledgement of the loss of the withdrawal right, and the required confirmation of that agreement.
Where required, ECUFiles.shop will request this consent and acknowledgement during checkout and provide the appropriate confirmation.
A general “no refunds” statement does not override mandatory consumer rights.
Refunds and other remedies will be handled in accordance with applicable law. These may be available where a file is not supplied, is defective, does not conform to its description or where another legal entitlement applies.
If you experience a download or product issue, contact info@ecufiles.shop with your order number and a description of the problem.
7. Intellectual Property and Permitted Use
Unless expressly stated otherwise, purchased files and related materials are protected by applicable intellectual property laws and remain the property of their respective owners or licensors.
Subject to any additional licence conditions displayed with a product, the customer receives a limited, non-exclusive and non-transferable licence to use the purchased file for its intended lawful purpose.
Without our prior written authorisation, customers must not:
Resell or redistribute purchased files.
Share files publicly or provide them to unauthorised third parties.
Upload purchased files to public file-sharing platforms.
Repackage or commercially distribute files as their own products.
Circumvent technical restrictions or use our services to infringe intellectual property rights.
Purchasing a file does not transfer ownership of intellectual property unless expressly agreed in writing.
8. Website Availability
We aim to maintain reliable access to ECUFiles.shop and its downloads. However, uninterrupted availability cannot be guaranteed.
Temporary interruptions may occur due to maintenance, hosting issues, security measures or circumstances beyond our reasonable control.
If an interruption prevents access to a purchased product, please contact us so that we can investigate and provide an appropriate remedy where required.
9. Limitation of Liability
To the extent permitted by applicable law, we are not liable for losses resulting from misuse of a file, incorrect customer-supplied information, incompatible equipment, improper installation or unlawful vehicle modifications.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including applicable mandatory consumer rights.
10. Privacy
Personal data is processed in accordance with our separate Privacy Policy, available on ECUFiles.shop.
The Privacy Policy explains what information we collect, why we collect it, how it is used, and what rights customers have under applicable data protection legislation.
11. Complaints and Customer Support
For questions about orders, downloads, compatibility or complaints, contact:
Email: info@ecufiles.shop
Please include your order number where relevant. We will make reasonable efforts to investigate and resolve complaints.
Consumers retain any mandatory rights to contact competent consumer protection authorities, use applicable dispute resolution procedures or bring proceedings before a competent court.
12. Governing Law
These Terms are governed by Hungarian law, without prejudice to mandatory consumer protection provisions that may apply under the law of the customer’s country of habitual residence.
Nothing in these Terms removes any mandatory rights available to consumers under applicable EU or national law.
13. Changes to These Terms
We may update these Terms to reflect changes to our business, website, products or applicable legislation.
The latest version will be published on this page. Changes will not unlawfully remove rights already accrued under existing contracts.
